Los Angeles Fire Department commanders are suing the department

LA fire officials claim whistleblowing retaliation

LOS ANGELES -- Two Los Angeles Fire Department commanders are suing the department for allegedly retaliating against them for reporting misconduct.

A July 1 lawsuit by Battalion Chief John Miller and Capt. Michael Rueda claims they were removed from the department's Arson Counter-Terrorism Section after they told superiors about violations of state or federal law.

They later returned to the unit but Rueda's attorney says both are under an internal affairs investigation.

The lawsuit doesn't specify the misconduct.

A call to a Fire Department community liaison official seeking comment wasn't immediately returned Thursday morning.
