Breaking News: Sandra Cantu case update - Sunday school teacher murder charge would “likely” include molestation charges

A public memorial service has been scheduled for 1 p.m. Thursday in the gymnasium of West High School.
Organizers have prepared for as many as 8,000 guests, but there’s only enough parking for 500 cars.

Update: 4-15-09 PM - Huckaby claims girl's death "an accident"

Tuesday, TV station KCRA 3 reported on its Web site that investigators close to the case said Huckaby admitted that Sandra Cantu's death was an accident.

Investigators also told KCRA 3 that Huckaby said she wrote the note that she had originally said she found the day after Cantu's March 27 disappearance.

Investigators told KCRA 3 that, according to Huckaby, the note read, "Cantu, Suitcase, Water" and also contained street names, including "Whitehall." The word "suitcase" was misspelled.

Sandra's body was found in a black suitcase in an irrigation pond near Whitehall Road on April 6. A few days later, Huckaby told a Tracy Press newspaper reporter that she had a similar suitcase stolen from her driveway the day Sandra disappeared. Huckaby was arrested April 10.

Tracy police Sgt. Tony Sheneman on Tuesday night said he couldn't comment on the TV report or about reports that Huckaby has confessed. Police have not disclosed where or how Sandra died.

Editor - This goes along with a theory I had that Sandra had been drugged and molested before and this time she overdosed accidently ...I also think this maybe the first arrest?...
Update: 4-14-09 PM - Count 1 - Murder with three special circumstances
Tears streaming down her face and chin trembling, a Sunday school teacher faced a judge and a packed courtroom today to hear charges of murder with special circumstances of kidnapping, lewd or lascivious acts with a 8-year-old neighbor child and rape by a foreign object.

The judge read that Huckaby "did willfully and unlawfully and intentionally and with malice aforethought murder Sandra Cantu, a human being

Tracy police served more search warrants yesterday at her fathers home and Clover Road Baptist church.

As charged, Huckaby could face the death penalty or life in prison without parole. That’s something prosecutors will bring up later in the case, said San Joaquin County District Attorney Jim Willett.

Results of Sandra’s autopsy have yet to be released and might not be for several weeks.

Sources have confirmed that they believe murder suspect Melissa Huckaby killed 8-year-old Sandra Cantu inside the church where her grandfather is pastor.(1)

Update: 4-14-09 AM - Molestation, lewd and lascivious conduct with a child, and Rape with a foreign object charges and enhancements being considered by District Attorney - Additional charges will be announced today.

Formal charges have not been filed, but San Joaquin County Deputy District Attorney Robert Himmelblau said Monday a murder charge against Huckaby would “likely” include the special circumstances of rape with a foreign object, lewd and lascivious conduct with a child and murder in the course of a kidnapping.

A conviction on any of the special circumstances would make Huckaby eligible for the death penalty or life in prison without parole, Himmelblau said.
The district attorney's office hasn't determined whether to seek the death penalty, he said.

Huckaby, a mother of a 5-year-old and a neighbor of Sandra's, was arrested late Friday night. Sandra's body was found in a suitcase in an irrigation pond April 6. She went missing from her mobile home park community March 27, sparking a massive search.

Tracy police Sgt. Tony Sheneman declined to comment on Himmelblau's comments. However, media sources who met with Himmelblau in person Monday said he confirmed that the additional charges would be announced today and said that because of the special circumstances charges, Huckaby would be eligible for the death penalty.

  1. I think that the death penalty is in order for melissa. I hope that her daughter dose not have to live a horrible life from her mothers horrible acts. It is not her daughters fault and she as a five yr old lil girl should not be punished for what her mother has done.I also think that the lil girl needs the most attention and love for she now has aslo lost a big impact in her life to i do feel she is safer without her mom even though she may be hurt that she dose not have her anymore.
