Charges To Be Filed As A Result Of Telegraph Fire
Thursday, September 11, 2008 - 10:00 AMMariposa, CA -- Mariposa County District Attorney Bob Brown has decided to file charges against 29 year old Davin Craig Mosher, the party responsible for starting the $40 million Telegraph Fire that destroyed 30 homes and burned more than 34,000 acres.
Even though Mosher immediately reported and admitted starting the August 25 fire near the Merced River on B.L.M. land, charges are being filed because Mosher was using steel-jacketed ammunition. According to CAL Fire investigators the steel used in the bullet was responsible for igniting the fire. Such ammunition is manufactured in China, Russia and many of the former Soviet eastern bloc countries. Steel is cheaper to use in the manufacturing process as opposed to copper. The weapon used was a Chinese SKS semi-automatic rifle with 7.62x39 caliber ammunition.
Mosher has claimed he did not realize he was firing steel jacketed bullets because they were covered with a thin copper coating to make them appear to be copper-jacketed bullets which reportedly will not produce enough heat to ignite a fire.
As for the sentence, Brown says Mosher will be charged with a misdemeanor rather than a felony. He will probably be assigned community service hours. Brown added Mosher will not receive any jail time.
